Diaz Reus scored a key victory last week on behalf of City of Miami Police officers who are pursuing damages against the City over an improperly administered promotional exam. The Third District Court of Appeal summarily rejected the City’s jurisdictional arguments allowing the case to move forward. Diaz, Reus & Targ, LLP partner Brant C. Hadaway argued in response to the City’s petition.
The case stems from a 1993 sergeant’s promotional exam that was improperly administered by the City of Miami, and caused many officers, including the 21 represented by DRT, to be denied promotion to the position of Sergeant. That improper denial caused these and other officers significant harm in the form of lost compensation and further promotional opportunities.
