MIAMI – September 11, 2023 – Diaz Reus International Law Firm (DRT) today announced that it has obtained a dismissal, with prejudice, in an environmental case against Miami Wilds.
The dismissal came on a Motion for Reconsideration. DRT attorney Mitchell Jagodinski was pleased with the Court’s decision to resolve all issues and parties with this ruling, commenting: “The key to this result was persistence. We did not let up until the Court was apprised of all the information it needed to make the right decision. Opposing counsel made claims it could not back up, and we were quick to call them on it at every turn.”
The Motion highlighted deficiencies in Plaintiffs’ pleadings, which previously allowed one claim to survive a motion to dismiss. After review, the Court dismissed the case with prejudice, agreeing that Plaintiffs had failed to meet their burden.
