\"\"<\/a>On September 20, 2018, President Donald J. Trump issued Executive Order 13849 (\u201cE.O.\u201d),\u00a0\u201cAuthorizing the Implementation of Certain Sanctions Set Forth in the Countering America\u2019s Adversaries Through Sanctions Act [CAATSA].\u201d\u00a0\u00a0Notably, the E.O.\u00a0authorizes the Secretary of the Treasury (\u201cTreasury\u201d) to take certain actions to further implement the sanctions imposed on a person pursuant to CAATSA or to the Ukraine Freedom Support Act (\u201cUFSA\u201d).\u00a0\u00a0It also directs the U.S. Government\u2019s relevant agencies and departments to take all appropriate measures within their authority to ensure the full implementation of those sanctions.<\/p>\n

Specifically, the E.O. authorizes Treasury to take the following measures against the sanctioned person:\u00a0(i) prohibit U.S. financial institutions from issuing\u00a0loans<\/a>\u00a0of more than $10 million in a 12-month period; (ii) prohibit forex transactions subject to U.S. jurisdiction that involve the sanctioned person;\u00a0(iii)\u00a0prohibit the transfer of credit or payments between financial institutions under U.S. jurisdiction that involve the sanctioned person;\u00a0(iv)\u00a0block the sanctioned person\u2019s property under U.S. jurisdiction; and\u00a0(v)\u00a0prohibit all U.S. citizens, permanent residents, businesses and financial institutions (\u201cU.S. Persons\u201d)\u00a0from buying certain equity or\u00a0debt<\/a>\u00a0from the sanctioned person.<\/p>\n

Additionally, the E.O. requires relevant U.S. Government agencies to take the following additional measures against the sanctioned person, in consultation with Treasury and the\u00a0Secretary of State (\u201cSecty\u201d): (i) the U.S.\u00a0Export-Import Bank must deny\u00a0the issuance of any guarantee, insurance, or extension of credit to the sanctioned person; (ii) relevant government agencies and departments must deny the sanctioned person any license or permission for the export or reexport of goods or technology that require the U.S. Government\u2019s approval; (iii)\u00a0the U.\u00a0S. executive director of each international financial institution shall oppose any\u00a0loan<\/a>from the international financial institution that would benefit the sanctioned person; and\u00a0(iv)\u00a0Secty shall deny a visa to, and the Secretary of\u00a0Homeland Security<\/a>\u00a0shall exclude from the United States, any alien that Treasury sanctions pursuant to\u00a0CAATSA or UFSA.<\/p>\n

In case that the target of a sanction under CAATSA or UFSA is a legal entity, the E.O. also authorizes Treasury and the rest of the U.S. Government agencies and departments\u00a0to impose the above measures on the legal entity’s principal executive(s).<\/p>\n

The Treasury\u2019s\u00a0Office<\/a>\u00a0of Foreign Assets Control (\u201cOFAC\u201d) anticipates promulgating regulations to implement these sanctions. OFAC will also issue the appropriate administrative subpoenas and\u00a0licenses, and will penalize\u00a0sanctions violations.<\/p>\n
