{"id":6875,"date":"2019-11-07T19:53:21","date_gmt":"2019-11-07T19:53:21","guid":{"rendered":"https:\/\/diazreus.com\/ofac-issues-new-regulations-regarding-its-venezuela-related-sanctions-2\/"},"modified":"2021-01-14T14:35:12","modified_gmt":"2021-01-14T14:35:12","slug":"ofac-issues-new-regulations-regarding-its-venezuela-related-sanctions-2","status":"publish","type":"post","link":"https:\/\/diazreus.com\/ru\/ofac-issues-new-regulations-regarding-its-venezuela-related-sanctions-2\/","title":{"rendered":"OFAC ISSUES NEW REGULATIONS REGARDING ITS VENEZUELA-RELATED SANCTIONS"},"content":{"rendered":"<p>&nbsp;<\/p>\n<div align=\"justify\"><a class=\"dt-pswp-item\" href=\"https:\/\/diazreus.com\/wp-content\/uploads\/2017\/10\/NF-blog.png\" data-dt-img-description=\"\" data-large_image_width=\"960\" data-large_image_height=\"640\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-13335 alignleft\" src=\"https:\/\/diazreus.com\/wp-content\/uploads\/2020\/11\/NF-blog-300x200-1.png\" alt=\"\" width=\"300\" height=\"200\" \/><\/a>On November 5, 2019, the Office of Foreign Assets Control (\u201cOFAC\u201d) issued new regulations regarding Executive Order (\u201cE.O.\u201d) 13884 whereby, on August 5, 2019,\u00a0\u00a0President Donald Trump (i) blocked all\u00a0property or interest in property of the Government of Venezuela\u00a0within or transiting U.S. jurisdiction; (ii) prohibited\u00a0U.S. persons from\u00a0engaging in any transactions with the Government of Venezuela or entities in which it has, directly or indirectly,\u00a050%\u00a0or greater ownership interest; and (iii)\u00a0\u00a0authorized\u00a0OFAC to include in its Specially Designated Nationals and Blocked Persons list any person that is determined, in consultation with the Secretary of State, to have materially assisted, sponsored, or provided support to the Government of Venezuela; or be owned or controlled by, or to have acted or purported to act for, or on behalf of, the Government of Venezuela.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">The term \u2018\u2018Government of Venezuela\u2019\u2019 includes the State and Government of Venezuela, any political subdivision, agency, or instrumentality thereof, including the Central Bank of Venezuela and Petroleos de Venezuela, S.A. (PDVSA), any person owned or controlled by the foregoing, and any person who has acted or purported to act for or on behalf of, any of the foregoing.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">Specifically, OFAC issued General License No. 34A expanding the authorizations initially established by General License No. 34 for certain transactions and activities that would be otherwise prohibited by E.O.\u00a013884. General License No. 34A now authorizes operations with current employees and contractors of the Government of Venezuela who provide health or education services in Venezuela, including at hospitals, schools, and universities. It also authorizes that individuals covered by this general license receive salaries, pensions, annuities,\u00a0\u00a0or other employment-related payments or benefits.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">On the same date, OFAC issued\u00a0General License No. 35 \u201cAuthorizing Certain Administrative Transactions with the Government of Venezuela.\u201d Particularly, this general license authorizes\u00a0U.S. persons to pay taxes, fees, and import duties to the Government of Venezuela, and to purchase or receive permits, licenses, registrations, certifications, and public utility services from the Government of Venezuela, so long as these transactions are necessary and ordinarily incident to such persons\u2019 day-to-day operations.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\"><\/div>\n<div align=\"center\"><strong>DRT Commentary<\/strong><\/div>\n<div align=\"center\"><\/div>\n<div align=\"justify\">With these new general licenses, OFAC counteracted the undesired effects that E.O. 13884 had for persons providing humanitarian services in Venezuela, or that, because of their day to day activities, had to make legal payments to the Government of Venezuela. In any event, persons subject to OFAC\u2019s jurisdiction conducting\u00a0transactions under these general licenses should take the necessary measures to\u00a0ensure compliance with the terms of the authorization. For example,\u00a0General Licenses No. 34A and 35 do not authorize\u00a0the\u00a0unblocking\u00a0of\u00a0<wbr \/>funds blocked pursuant\u00a0to,\u00a0or\u00a0the\u00a0<wbr \/>processing\u00a0of\u00a0any\u00a0transactions prohibited under,\u00a0any\u00a0executive\u00a0order other than E.O. 13884. In addition,\u00a0these\u00a0persons must file periodic reports pursuant\u00a0to\u00a0OFAC regulations.<\/div>\n<div align=\"justify\">\n<div
