(la \u201cO.E.\u201d). Si bien esta no es la primera vez que el Gobierno de EE.UU. impone sanciones\u00a0econ\u00f3micas\u00a0al Gobierno de Venezuela, las sanciones anteriores\u00a0restring\u00edan\u00a0<wbr \/>operaciones que involucraban cierta deuda o bienes de ese Gobierno, o ciertos individuos y entidades listados en la Lista de Nacionales Especialmente Designados y Personas Bloqueadas (\u201cLista SDN\u201d, por sus siglas en ingl\u00e9s). Con la O.E., si no est\u00e1n autorizadas por OFAC, las personas de EE.UU. tienen prohibido participar en todas las transacciones con las personas que cumplan con la definici\u00f3n de \u201cGobierno de Venezuela\u201d o con entidades en las que tengan, directa o indirectamente, un 50% o m\u00e1s de inter\u00e9s accionario independientemente de si la persona aparece en la Lista SDN.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">Bajo la O.E., el t\u00e9rmino \u201cGobierno de Venezuela\u201d incluye al Estado y Gobierno de Venezuela, cualquier\u00a0subdivisi\u00f3n\u00a0<wbr \/>pol\u00edtica, agencia, o instrumento de ellas, incluyendo el Banco Central de Venezuela y\u00a0Petr\u00f3leos\u00a0de Venezuela, S.A. (PDVSA), cualquier persona que le pertenezca o est\u00e9 controlada por ellas, y cualquier persona que haya actuado o intentado actuar para, o en beneficio de, cualquiera de las anteriores.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">La O.E. tambi\u00e9n autoriza a OFAC a incluir en su Lista SDN a cualquier persona que se determine, en consulta con el Secretario de Estado, que (i) ha asistido materialmente, patrocinado, o suministrado apoyo al Gobierno de Venezuela; (ii) pertenece o es controlada por, o ha\u00a0actuado\u00a0o intentado actuar para o en representaci\u00f3n de, el Gobierno de Venezuela. En consecuencia, las personas que participen en cualquier tipo de transacci\u00f3n con el Gobierno de Venezuela corren el riesgo de enfrentar sanciones OFAC. Previamente, una persona estar\u00eda sujeta a este riesgo solo si la transacci\u00f3n con el Gobierno de Venezuela estaba ligada a corrupci\u00f3n, abusos de derechos humanos, u otras actividades ilegales.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">En la misma fecha, OFAC modific\u00f3 sus Licencias Generales\u00a02A, 3F, 4C, 7C, 8C, 9E, 10A, 13C, 15B, 16B, 18A, 20A, para aclarar que estas licencias no\u00a0except\u00faan\u00a0transacciones prohibidas por la O.E. distintas a las que se encuentran mencionadas directamente por las Licencias Generales de OFAC.\u00a0\u00a0OFAC\u00a0tambi\u00e9n\u00a0expidi\u00f3 las Licencias Generales 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, y sus \u201cLineamientos Relacionados a la Provisi\u00f3n de Ayuda y Apoyo Humanitario al Pueblo Venezolano\u201d, para prevenir que la O.E. tenga\u00a0consecuencias\u00a0no deseadas en ese pa\u00eds.<\/div>\n<div align=\"justify\"><\/div>\n<div align=\"justify\">Espec\u00edficamente, las nuevas regulaciones de OFAC aclaran que las Sanciones OFAC al Gobierno de Venezuela no\u00a0les\u00a0proh\u00edbena las personas de EE.UU. participar en transacciones que involucren al\u00a0pa\u00eds\u00a0o la gente de Venezuela, siempre que no involucren personas bloqueadas o conducta prohibida. Adicionalmente, las nuevas regulaciones de OFAC\u00a0\u00a0autorizan a las personas de EE.UU. a continuar proporcionando apoyo humanitario a los venezolanos, incluidas transacciones a trav\u00e9s del sistema financiero de EE.UU. para ciertas actividades autorizadas relacionadas con alimentos, materias primas agr\u00edcolas, medicamentos y dispositivos m\u00e9dicos; remesas personales no comerciales; organizaciones internacionales; telecomunicaciones y correo; Internet; servicios m\u00e9dicos; y organizaciones no gubernamentales.
