El\u00a05\u00a0de\u00a0noviembre\u00a0de 2019, la Oficina de Control de Activos Extranjeros (\u201cOFAC\u201d) expidi\u00f3 nuevas regulaciones relacionadas con la Orden Ejecutiva (\u201cO.E.\u201d) 13884 del 5 de agosto de 2019 por medio de la cual el Presidente Donald Trump (i) bloque\u00f3 toda propiedad o inter\u00e9s en propiedad del Gobierno de Venezuela\u00a0que se encuentre dentro de, o transitando por, la jurisdicci\u00f3n de EE.UU.; (ii) prohibi\u00f3 a las personas de EE.UU.\u00a0participar de cualquier transacci\u00f3n con el Gobierno de Venezuela\u00a0o con entidades en las que tenga, directa o indirectamente, un 50% o m\u00e1s de inter\u00e9s accionario; y\u00a0(iii)\u00a0autoriz\u00f3 a OFAC a incluir en su Lista de Nacionales Especialmente Designados y Personas Bloqueadas a cualquier persona que se determine, en consulta con el Secretario de Estado, que ha asistido materialmente, patrocinado, o suministrado apoyo al Gobierno de Venezuela; o que pertenece o es controlada por, o ha actuado o intentado actuar para o en representaci\u00f3n de, el Gobierno de Venezuela.<\/div>\n

El t\u00e9rmino \u201cGobierno de Venezuela\u201d incluye al Estado y Gobierno de Venezuela, cualquier\u00a0subdivisi\u00f3n\u00a0pol\u00edtica, agencia, o instrumento de ellas, incluyendo el Banco Central de Venezuela y\u00a0Petr\u00f3leos\u00a0de Venezuela, S.A. (PDVSA), cualquier persona que le pertenezca o est\u00e9 controlada por ellas, y cualquier persona que haya actuado o intentado actuar para, o en beneficio de, cualquiera de las anteriores.<\/div>\n
<\/div>\n
Espec\u00edficamente, OFAC expidi\u00f3 la Licencia General No. 34A\u00a0ampliando las autorizaciones\u00a0establecidas inicialmente por la Licencia General No. 34A para llevar a cabo ciertastransacciones y actividades\u00a0que de otra manera estar\u00edan prohibidas por la O.E.\u00a013884.\u00a0\u00a0La Licencia General No. 34A ahora autoriza operaciones con empleados y contratistas del Gobierno de Venezuela que suministren servicios de salud o educaci\u00f3n en Venezuela, incluyendo en hospitales, escuelas y universidades.\u00a0\u00a0Tambi\u00e9n autoriza que los individuos cobijados por esta licencia general reciban salarios, pensiones, rentas anuales, u otros pagos o beneficios relacionados con su empleo.<\/div>\n

En la misma fecha, OFAC\u00a0tambi\u00e9n expidi\u00f3 la\u00a0Licencia General No. 35 \u201cAutorizando Ciertas Transacciones Administrativas con el Gobierno de Venezuela\u201d. En particular, esta licencia general autoriza a las personas de EE.UU. a pagar impuestos, tasas, y derechos de importaci\u00f3n a, y comprar o recibir permisos, licencias, registros, certificaciones, y servicios de utilidad p\u00fablica de, el Gobierno de Venezuela, siempre que estas transacciones sean necesarias y ordinariamente incidentales a las operaciones del d\u00eda a d\u00eda de estas personas.<\/div>\n

Con estas nuevas licencias generales, OFAC contrarresta los efectos indeseados que la O.E. 13884 ten\u00eda para aquellas personas que prestan servicios humanitarios en Venezuela, o que, por sus actividades del d\u00eda a d\u00eda, deben hacer pagos legales al Gobierno de Venezuela. En todo caso, las personas sujetas a la jurisdicci\u00f3n de OFAC que lleven a cabo transacciones bajo estas licencias generales deben tomar las medidas\u00a0necesarias\u00a0para asegurar su cumplimiento con los t\u00e9rminos de la autorizaci\u00f3n. Por ejemplo, las licencias generales No. 34A y 35 no autorizan el desbloqueo de fondos bloqueados conforme a, o el procesamiento de cualquier transacci\u00f3n\u00a0bajo, cualquier orden ejecutiva distinta a la O.E.\u00a013884.
